The short version
- Only post content you own or have permission to use.
- If your work is on Blush without permission, send a takedown notice to our Copyright Agent with the details listed below.
- If your content was removed by mistake, you can send a counter-notice.
- We close the accounts of repeat infringers.
- If you appear in content without consent, that's a privacy and safety issue, not a copyright one. Report it under our Content Policy instead.
1. Our policy
TXTBOO LLC respects the intellectual property rights of others and expects everyone on Blush to do the same. We respond to notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512, the "DMCA") and other applicable laws. We may remove or disable access to content and, in appropriate circumstances, close the accounts of people who repeatedly infringe.
2. Our Copyright Agent
Send copyright notices and counter-notices to our designated agent:
Frederick, MD 21703, United States
csuite@txtboo.com (subject: "DMCA Notice")
3. Sending a takedown notice
To be effective, your notice must be in writing and include:
- your physical or electronic signature, as the copyright owner or a person authorized to act for them;
- identification of the copyrighted work you say has been infringed (or, if several works are involved, a representative list);
- identification of the material you say is infringing, with enough information for us to find it, ideally the link to each post or profile on Blush;
- your name, mailing address, telephone number and email address;
- a statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent or the law; and
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for them.
When we receive a valid notice, we will remove or disable access to the material promptly and let the person who posted it know. We may share a copy of your notice, including your name and contact details, with that person so that they can respond.
Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages. Please consider whether the use may be authorized or a fair use before you send a notice.
4. Sending a counter-notice
If your content was removed because of a copyright notice and you believe that was a mistake or a misidentification, you can send our Copyright Agent a counter-notice that includes:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before it was removed;
- a statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification;
- your name, address and telephone number; and
- a statement that you consent to the jurisdiction of the U.S. federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which TXTBOO LLC may be found), and that you will accept service of process from the person who sent the original notice, or their agent.
When we receive a valid counter-notice, we'll send a copy to the person who sent the original notice. If they don't tell us within 10 business days that they have filed a court action to stop the infringement, we'll restore the material 10 to 14 business days after we received your counter-notice, as long as it doesn't break our other policies.
5. Repeat infringers
We keep a record of copyright notices. We will close the accounts of people who are the subject of repeated valid notices, or who we otherwise find to be repeat infringers. Creators whose accounts are closed under this section are subject to the Creator Terms on holds and payouts.
6. Other intellectual property and other complaints
For trademark complaints, or other intellectual property concerns that aren't about copyright, email csuite@txtboo.com with the subject "IP complaint". Describe your rights, the content involved and where it is on Blush.
If the problem is that you appear in content without your consent, that someone under 18 appears in content, or that your private information has been shared, please report it under our Content Policy. Those reports don't need the formal details above, and we handle them as a priority.
